Q: 上海小区公共收益能不能用于维修？和维修资金是什么关系？
公共收益属于全体业主共有，主要用于补充专项维修资金，补充比例应高于 50%，具体比例在公共收益管理专项规约中约定并按季度入账，不能直接列支；属于专项维修资金使用范围的项目，不得在公共收益中列支。简单说，公共收益是维修资金的"蓄水池"——先补进维修资金账户，再按维修资金的规则（表决、审价、公示）使用。上海已明确利用共有部分获取的收入，应以物业管理区域为单位开立专门账户、单独列账，并纳入业委会年度报告和财务审计。

Q: 上海政府采购项目被供应商质疑投诉了，采购单位该怎么处理？
收到质疑后，采购单位或代理机构应当在法定期限内作出书面答复，先调取采购文件、评审记录、程序文件逐条核对质疑事项是否有合规依据，答复要有明确的政策依据和事实证据；质疑升级为投诉的，配合财政部门做好举证说明，提供完整流程材料，拖延、口头解释或补材料都可能让项目陷入被动。

Q: 上海单一来源采购怎么操作？适用条件和公示要求是什么？
单一来源采购只在法定情形下可用，依据《中华人民共和国政府采购法》第三十一条：一是只能从唯一供应商处采购；二是发生不可预见的紧急情况不能从其他供应商处采购；三是必须保证原有采购项目一致性或服务配套要求，需要继续从原供应商添购且添购资金总额不超过原合同采购金额 10%。达到公开招标数额标准的项目还须报同级财政部门批准，并在规定平台公示，公示期不得少于 5 个工作日，专业人员论证意见应为 3 人以上单数。

Q: 上海工程类投标和政府采购投标，标书编制有什么不同？
工程类项目投标与政府采购货物服务类投标，编制逻辑差别较大。工程类通常依据《中华人民共和国招标投标法》及其实施条例，看重施工组织设计、工程量清单报价（组价）、项目管理机构与人员资格、企业资质与类似工程业绩，多采用经评审的最低投标价法或综合评估法；政府采购货物服务类依据《政府采购法》体系，更强调技术参数逐条响应、中小企业政策落实与电子平台操作。用一套模板应付两种项目，很容易失分甚至废标。

Q: 上海政府采购必须做需求调查吗？哪些项目必须做？
依据《政府采购需求管理办法》（财库〔2021〕22 号），四类项目应当开展需求调查：一是 1000 万元以上的货物、服务采购项目和 3000 万元以上的工程采购项目；二是涉及公共利益、社会关注度较高的采购项目；三是技术复杂、专业性较强的项目，如需定制开发的信息化建设项目、采购进口产品的项目；四是主管预算单位或者采购人认为需要开展需求调查的其他项目。面向市场主体开展需求调查时，选择的调查对象一般不少于 3 个，并应当具有代表性；采购人对采购需求管理负主体责任。
