Q: 上海单一来源采购怎么操作？适用条件和公示要求是什么？
单一来源采购只在法定情形下可用，依据《中华人民共和国政府采购法》第三十一条：一是只能从唯一供应商处采购；二是发生不可预见的紧急情况不能从其他供应商处采购；三是必须保证原有采购项目一致性或服务配套要求，需要继续从原供应商添购且添购资金总额不超过原合同采购金额 10%。达到公开招标数额标准的项目还须报同级财政部门批准，并在规定平台公示，公示期不得少于 5 个工作日，专业人员论证意见应为 3 人以上单数。

收到质疑后，采购单位或代理机构应当在法定期限内作出书面答复，先调取采购文件、评审记录、程序文件逐条核对质疑事项是否有合规依据，答复要有明确的政策依据和事实证据；质疑升级为投诉的，配合财政部门做好举证说明，提供完整流程材料，拖延、口头解释或补材料都可能让项目陷入被动。

Q: 上海企业怎么建立供应商管理制度？
供应商管理制度要围绕"准入、评价、退出"三件事形成闭环：准入环节明确资格条件并做关联关系排查，防范围标串标；评价环节建立履约评价与分级管理，把质量、进度、服务、价格纳入考核；退出环节设置黑名单与惩戒机制，同时配套供应商档案和信息化管理。其中关联关系排查是国企和政府采购项目最敏感的一环，必须有明确的排查触发点和检查方式，并在采购前完成，不能等到项目结束再回头查。

Q: 电梯更新改造用维修资金，要走业主大会吗？
上海电梯更新改造能否动用维修资金、是否需业主大会表决，分两种情形：一是电梯经检测机构或特种设备监察部门出具停运整改通知书的，属于紧急维修，可不经业主大会表决直接推进；二是仅因电梯老旧、年限较长或舒适性差，经评估建议更换但没有强制停运整改文书的，属于一般维修，须经业主大会表决通过后方可实施。

招标代理服务费目前实行市场调节价——《招标代理服务收费管理暂行办法》（计价格〔2002〕1980 号）已于 2016 年 1 月 1 日废止，国家层面对收费标准和支付主体不再作强制规定；实践中各方仍普遍自愿参照该办法的"差额定率累进"方法作为协商基准。科博商务的执行口径为最低 5000 元/项，收费构成、服务内容与支付方式在委托合同中明确约定。
