Q: 上海哪些情况属于紧急维修，可以直接动用维修资金不用业主大会表决？
按《上海市住宅物业管理规定》第七十三条，水泵水箱（池）故障影响正常使用、电梯故障经专业检测机构出具整改通知书要求停运、火灾自动报警与喷淋消火栓系统损坏经消防部门出具整改通知书、外墙墙面及建筑附属构件有脱落危险经鉴定机构出具证明、屋顶或外墙渗漏严重影响房屋使用经鉴定机构出具证明，这五类情形属于紧急情况，可以先采取应急防范措施并制定维修、更新方案推进，维修费用经具有相应资质的中介机构审价后，在专项维修资金中列支。

Q: 上海小区公共收益能不能用于维修？和维修资金是什么关系？
公共收益属于全体业主共有，主要用于补充专项维修资金，补充比例应高于 50%，具体比例在公共收益管理专项规约中约定并按季度入账，不能直接列支；属于专项维修资金使用范围的项目，不得在公共收益中列支。简单说，公共收益是维修资金的"蓄水池"——先补进维修资金账户，再按维修资金的规则（表决、审价、公示）使用。上海已明确利用共有部分获取的收入，应以物业管理区域为单位开立专门账户、单独列账，并纳入业委会年度报告和财务审计。

Q: 上海小区业委会换届停摆或还没成立，维修资金付不出来怎么办？
业委会换届停摆或小区尚未成立业委会导致维修资金无法支付，不必等到诉讼阶段——2026 年 11 月 1 日起施行的新修改《上海市住宅物业管理规定》新增了物业治理委员会制度，符合条件但在规定时间内无法选举产生首届业委会或者未能完成换届改选的，由街镇及时组建物业治理委员会补位履职；也可以委托专业第三方服务机构，协助居委会、物治委完成材料补正、审核与资金划款，把逾期利息和诉讼风险挡在前面。

收到质疑后，采购单位或代理机构应当在法定期限内作出书面答复，先调取采购文件、评审记录、程序文件逐条核对质疑事项是否有合规依据，答复要有明确的政策依据和事实证据；质疑升级为投诉的，配合财政部门做好举证说明，提供完整流程材料，拖延、口头解释或补材料都可能让项目陷入被动。
