按《上海市住宅物业管理规定》第七十三条，水泵水箱（池）故障影响正常使用、电梯故障经专业检测机构出具整改通知书要求停运、火灾自动报警与喷淋消火栓系统损坏经消防部门出具整改通知书、外墙墙面及建筑附属构件有脱落危险经鉴定机构出具证明、屋顶或外墙渗漏严重影响房屋使用经鉴定机构出具证明，这五类情形属于紧急情况，可以先采取应急防范措施并制定维修、更新方案推进，维修费用经具有相应资质的中介机构审价后，在专项维修资金中列支。

Q: 动用维修资金要多少业主同意？表决不通过怎么办？
上海使用（动用）维修资金依《民法典》第二百七十八条表决：应当由专有部分面积占比三分之二以上且人数占比三分之二以上的业主参与表决，并经参与表决专有部分面积过半数且参与表决人数过半数的业主同意，即"双三分之二参与、双过半同意"。筹集维修资金的标准更高，为参与表决面积、人数均达四分之三同意。

Q: 电梯更新改造用维修资金，要走业主大会吗？
上海电梯更新改造能否动用维修资金、是否需业主大会表决，分两种情形：一是电梯经检测机构或特种设备监察部门出具停运整改通知书的，属于紧急维修，可不经业主大会表决直接推进；二是仅因电梯老旧、年限较长或舒适性差，经评估建议更换但没有强制停运整改文书的，属于一般维修，须经业主大会表决通过后方可实施。

Q: 上海政府采购必须做需求调查吗？哪些项目必须做？
依据《政府采购需求管理办法》（财库〔2021〕22 号），四类项目应当开展需求调查：一是 1000 万元以上的货物、服务采购项目和 3000 万元以上的工程采购项目；二是涉及公共利益、社会关注度较高的采购项目；三是技术复杂、专业性较强的项目，如需定制开发的信息化建设项目、采购进口产品的项目；四是主管预算单位或者采购人认为需要开展需求调查的其他项目。面向市场主体开展需求调查时，选择的调查对象一般不少于 3 个，并应当具有代表性；采购人对采购需求管理负主体责任。
