Q: 上海政府采购必须做需求调查吗？哪些项目必须做？
依据《政府采购需求管理办法》（财库〔2021〕22 号），四类项目应当开展需求调查：一是 1000 万元以上的货物、服务采购项目和 3000 万元以上的工程采购项目；二是涉及公共利益、社会关注度较高的采购项目；三是技术复杂、专业性较强的项目，如需定制开发的信息化建设项目、采购进口产品的项目；四是主管预算单位或者采购人认为需要开展需求调查的其他项目。面向市场主体开展需求调查时，选择的调查对象一般不少于 3 个，并应当具有代表性；采购人对采购需求管理负主体责任。

标书编制一般按份收费、按项目类型与难易程度分级定价，具体价格以双方服务合同约定为准；时间安排上，建议在拿到招标文件后立即启动，为解读、编制、审核和内部确认留出完整周期，临近投标截止才启动，是漏项和废标风险最高的做法。

采购方式适用错误、采购文件设置倾向性或歧视性条款、电子流程与签章不规范、中小企业份额与价格扣除政策没落实、中标后合同签订超期、采购档案不完整，是采购单位在审计与巡查中最容易被追责的六类问题；这些问题多数并非主观违规，而是经办人对现行政策不熟、流程把关不到位造成的，通过采购前需求论证、文件三级审核和履约验收闭环可以有效规避。

Q: 上海小区物业服务费怎么调整？调价需要走什么程序？
物业服务费标准是物业服务合同的核心条款，调整属于合同变更，需要双方协商一致，并按业主共同决定程序进行。依据《中华人民共和国民法典》第二百七十八条，调整物业费属于业主共同决定事项，须由专有部分面积占比三分之二以上的业主且人数占比三分之二以上的业主参与表决，并经参与表决专有部分面积过半数且参与表决人数过半数的业主同意。物业公司单方张贴涨价通知不构成有效变更，业主有权拒绝支付涨价部分。上海新规进一步明确构建质价相符的物业行业市场调节机制。

Q: 听说2026年新规不能授权业委会批钱了，正在做的项目会不会有问题？
目前没有正式生效的 2026 新规 “直接取消业主大会对业委会的维修资金授权”；网传说法是对正在修订的法规草案误读。已经合法立项、正在实施的项目，不受影响，可以正常拨付尾款。
