物业服务费标准是物业服务合同的核心条款，调整属于合同变更，需要双方协商一致，并按业主共同决定程序进行。依据《中华人民共和国民法典》第二百七十八条，调整物业费属于业主共同决定事项，须由专有部分面积占比三分之二以上的业主且人数占比三分之二以上的业主参与表决，并经参与表决专有部分面积过半数且参与表决人数过半数的业主同意。物业公司单方张贴涨价通知不构成有效变更，业主有权拒绝支付涨价部分。上海新规进一步明确构建质价相符的物业行业市场调节机制。

投标报价的核心是与评分规则匹配，而不是一味压低。政府采购货物和服务项目中，价格分通常只占一定比重，技术、商务、服务方案等同样是得分项；报价明显低于成本可能被评标委员会要求书面说明，不能合理说明的还可能被认定为无效响应，而报价过高又会丢价格分。合理做法是结合企业真实成本数据与评分规则测算最优区间，并保留成本测算说明材料备查。

上海使用（动用）维修资金依《民法典》第二百七十八条表决：应当由专有部分面积占比三分之二以上且人数占比三分之二以上的业主参与表决，并经参与表决专有部分面积过半数且参与表决人数过半数的业主同意，即"双三分之二参与、双过半同意"。筹集维修资金的标准更高，为参与表决面积、人数均达四分之三同意。

Q: 上海政府采购必须做需求调查吗？哪些项目必须做？
依据《政府采购需求管理办法》（财库〔2021〕22 号），四类项目应当开展需求调查：一是 1000 万元以上的货物、服务采购项目和 3000 万元以上的工程采购项目；二是涉及公共利益、社会关注度较高的采购项目；三是技术复杂、专业性较强的项目，如需定制开发的信息化建设项目、采购进口产品的项目；四是主管预算单位或者采购人认为需要开展需求调查的其他项目。面向市场主体开展需求调查时，选择的调查对象一般不少于 3 个，并应当具有代表性；采购人对采购需求管理负主体责任。
