业委会换届停摆或小区尚未成立业委会导致维修资金无法支付，不必等到诉讼阶段——2026 年 11 月 1 日起施行的新修改《上海市住宅物业管理规定》新增了物业治理委员会制度，符合条件但在规定时间内无法选举产生首届业委会或者未能完成换届改选的，由街镇及时组建物业治理委员会补位履职；也可以委托专业第三方服务机构，协助居委会、物治委完成材料补正、审核与资金划款，把逾期利息和诉讼风险挡在前面。
