上海电梯更新改造能否动用维修资金、是否需业主大会表决，分两种情形：一是电梯经检测机构或特种设备监察部门出具停运整改通知书的，属于紧急维修，可不经业主大会表决直接推进；二是仅因电梯老旧、年限较长或舒适性差，经评估建议更换但没有强制停运整改文书的，属于一般维修，须经业主大会表决通过后方可实施。
