按《上海市住宅物业管理规定》第七十三条，水泵水箱（池）故障影响正常使用、电梯故障经专业检测机构出具整改通知书要求停运、火灾自动报警与喷淋消火栓系统损坏经消防部门出具整改通知书、外墙墙面及建筑附属构件有脱落危险经鉴定机构出具证明、屋顶或外墙渗漏严重影响房屋使用经鉴定机构出具证明，这五类情形属于紧急情况，可以先采取应急防范措施并制定维修、更新方案推进，维修费用经具有相应资质的中介机构审价后，在专项维修资金中列支。

Q: 上海老旧小区电梯更新改造，维修资金怎么用？能申请哪些补贴？
上海老旧住宅电梯更新、改造、修理的资金通常是"三条腿"拼起来的：专项维修资金（含公共收益补充部分）、业主按面积或楼层分摊、政策资金。政策资金方面，使用年限 15 年以上的老旧电梯更新已纳入超长期特别国债支持范围，按楼层数给予梯度补贴；对实施了电梯更新但专项维修资金不足的，业主本人及其配偶、本人父母、子女还可以提取住房公积金账户余额，用于支付业主实际承担的电梯更新分摊自筹部分。电梯更新属于改建建筑物附属设施，还须按《中华人民共和国民法典》第二百七十八条走业主表决程序。

目前没有正式生效的 2026 新规 “直接取消业主大会对业委会的维修资金授权”；网传说法是对正在修订的法规草案误读。已经合法立项、正在实施的项目，不受影响，可以正常拨付尾款。

两者最大的区别在法律适用范围：政府采购适用《中华人民共和国政府采购法》及其实施条例，采购人主要是国家机关、事业单位和团体组织，资金具有财政性，必须执行集中采购目录、采购限额标准、信息公开、质疑投诉、中小企业政策等强制性要求；国企采购属于企业自主经营范畴，不直接适用《政府采购法》，主要受《中华人民共和国招标投标法》及其实施条例、国资监管要求和内部制度约束——依法必须招标的项目达到规模标准仍须招标，其余可自主确定采购方式，但必须制度留痕、廉洁合规。
