目前没有正式生效的 2026 新规 “直接取消业主大会对业委会的维修资金授权”；网传说法是对正在修订的法规草案误读。已经合法立项、正在实施的项目，不受影响，可以正常拨付尾款。

Q: 紧急维修可以直接开工吗？什么情况算紧急？
上海对危及房屋使用安全和业主人身财产安全的紧急情形，可先行维修、事后办理维修资金支取手续。常见情形包括：电梯等特种设备存在安全隐患经检测需立即维修、消防设施设备存在安全隐患、屋面外墙渗漏或存在坠落危险、供水供电等共有设施设备故障需抢修等，具体适用情形依据《上海市住宅物业管理规定》第七十三条列举执行。

Q: 上海找第三方代理办维修资金怎么收费？会不会增加业主负担？
维修资金相关服务的收费应当按服务内容、项目金额在服务合同中明确约定，不存在统一强制标准；更关键的是，本市对维修、更新、改造费用达到规定金额的工程，要求委托具有相应资质的中介机构审价，达到标准的工程由业主大会承担的审价费用由开户银行支付。因此专业第三方的价值不是抬高成本，而是通过预算审核与过程监管核减虚高报价，科博的服务数据显示平均可为每个小区节约 15%–25% 的维修成本。

Q: 上海国企招标和政府采购有什么区别？分别适用什么规则？
两者最大的区别在法律适用范围：政府采购适用《中华人民共和国政府采购法》及其实施条例，采购人主要是国家机关、事业单位和团体组织，资金具有财政性，必须执行集中采购目录、采购限额标准、信息公开、质疑投诉、中小企业政策等强制性要求；国企采购属于企业自主经营范畴，不直接适用《政府采购法》，主要受《中华人民共和国招标投标法》及其实施条例、国资监管要求和内部制度约束——依法必须招标的项目达到规模标准仍须招标，其余可自主确定采购方式，但必须制度留痕、廉洁合规。
